1. STATUS & TAXES: I understand that I am an Independent Contractor (IC) and not an employee of Errandeer Limited. I am solely responsible for filing and paying my own statutory deductions, education tax, and income taxes to Tax Administration Jamaica (TAJ).
2. PAYMENTS & ESCROW: I authorize Errandeer Limited to hold customer task funds securely in platform escrow until an errand is verified as completed. I agree to the flat 20% platform marketplace commission deduction from my gross earnings prior to my weekly Friday bank transfer payout.
3. ZERO-CASH POLICY: I agree to never collect physical cash from clients or use my own personal money to purchase items for an errand. All payments for tasks, materials, or reimbursements must be processed directly through the Errandeer platform checkout system.
4. COMMUNICATION: I agree to keep all task-related communication and payment arrangements strictly inside the Errandeer platform. Bypassing the platform to arrange off-site payments will result in the immediate and permanent termination of my account.
5. LIABILITY & ACCIDENTS: I explicitly acknowledge that Errandeer Limited is a digital marketplace matching platform and does not provide insurance coverage. I am solely liable for any personal injuries, traffic accidents, traffic tickets, or physical damages incurred while executing an errand.
6. LOSS & DAMAGES: I agree that I am fully responsible for any loss, theft, or physical damage to a client’s property or goods while they are in my custody during an errand. I agree to indemnify and hold harmless Errandeer Limited from any claims arising from my performance of services.
7. INDEPENDENT VERIFICATION: I hereby grant Errandeer Limited full permission to verify my uploaded Government ID, Tax Registration Number (TRN), and to submit my Police Certificate to the Jamaica Constabulary Force (JCF) or relevant authorities for background screening and authenticity authentication.
8. BANK FEES & MINIMUM PAYOUTS: I acknowledge that the 80% net payout calculation is subject to local banking transaction fees. All incoming payment gateway charges and outgoing electronic bank transfer fees (ACH/RTGS) charged by the financial institution will be automatically deducted directly from my earnings balance prior to transfer. Furthermore, I agree that I must accumulate a minimum balance of $2,000.00 JMD in my digital wallet before a Friday payout can be initiated.
9. ANTI-POACHING RESTRICTION: I agree that for a period of 24 months following my introduction to a client through the Errandeer platform, I will not solicit, contract, or perform off-platform services directly for that client. Any attempt to bypass Errandeer to avoid platform fees will result in the immediate forfeiture of any remaining wallet balances and permanent termination of my account.
10. UNILATERAL DEACTIVATION RIGHTS: I explicitly acknowledge that Errandeer Limited retains the absolute right to temporarily suspend or permanently deactivate my account at any time, with or without prior notice, for any suspected violation of platform policies, fraudulent activity, or behavior that threatens user safety. I understand that I have no right to appeal a permanent security deactivation.
11. INDEPENDENT BUSINESS OWNERSHIP & TOOLS: I confirm that I operate as an independent contractor and maintain my own tools, equipment, supplies, and protective gear required to perform tasks safely. Errandeer Limited will not provide, fund, or reimburse any materials or tool assets needed for my service executions.
12. MANDATORY INFORMAL DISPUTE RESOLUTION: In the event of a payment dispute, rating disagreement, or service complaint between myself and a client or the platform, I agree to submit the dispute in writing to Errandeer Customer Support. I explicitly agree to allow Errandeer representatives a minimum period of thirty (30) days to negotiate and mediate the issue informally before initiating any external legal proceedings.
13. DATA PROTECTION COMPLIANCE (JDPA 2020): I acknowledge that Errandeer Limited is a registered Data Controller under the Jamaica Data Protection Act (JDPA) 2020. I explicitly consent to the digital processing, electronic indexing, and cloud storage of my personal identifiable information (PII), including my National ID, TRN, Police Certificate, and Banking details. I understand that my data is securely encrypted, will never be sold to third parties, and will be securely retained or permanently destroyed strictly in accordance with the regulatory standards enforced by the Office of the Information Commissioner (OIC).
14. DATA INTEGRITY & SYSTEM MISUSE (CYBERCRIMES ACT 2015): I agree that I will not attempt to alter, breach, intercept, or introduce unauthorized code or malicious scripts into the Errandeer website or database engine. I explicitly understand that inputting fraudulent data, masquerading under a false name/identity, or manipulating payment logs constitutes an offense under the Cybercrimes Act 2015, and Errandeer Limited will instantly turn over all systemic tracking logs, device IP coordinates, and network records to the Jamaica Constabulary Force (JCF) Communication Forensics and Cybercrime Division (CFCD) for criminal prosecution.
15. PROHIBITED ERRANDS & GOODS: I explicitly agree to never accept, solicit, transport, or facilitate any task involving illegal contraband, illicit drugs, unlicensed weapons, hazardous chemicals, stolen merchandise, or any activity requiring specialized state licensing (such as medical transport or professional legal counsel) through this platform. I acknowledge that if an unauthorized or illegal item is discovered in my custody during an errand, I assume 100% legal liability, and Errandeer Limited is completely indemnified from any related law enforcement interventions.
16. INTELLECTUAL PROPERTY & BRAND PROTECTION: I explicitly acknowledge that all trademarks, logos, system layouts, graphics, and brand assets are the exclusive intellectual property of Errandeer Limited. I understand that my approved status as an Independent Contractor grants me a limited, non-exclusive license to use the platform workspace only. I am strictly prohibited from using the “Errandeer” name, corporate logos, or brand identity to promote my own off-platform independent business operations, print custom business cards using platform branding, or misrepresent myself to the public as an official corporate employee, partner, or legal representative of Errandeer Limited.
